- General
1.1. The minimum order amount is €0.00.
1.2. The flat rate shipping fee for shipping within Germany (with advance payment) is €9.00 for 1-18, 0.7-liter bottles.
1.3. For cash on delivery deliveries, an additional €10.00 will be charged. For cash on delivery deliveries, the maximum weight is limited to 20 kg (approx. 12 bottles). An additional €2.00 fee will be charged, which must be paid directly to the courier. Therefore, the total amount to be paid exceeds the invoice amount by €2.00.
- Delivery Times
2.1. Ordered goods are ideally delivered within seven days.
2.2. If non-compliance with or delay in an agreed delivery deadline is due to force majeure, unforeseen obstacles, or other circumstances beyond big market's control, the delivery deadline will be extended for the duration of these events. This applies accordingly if big market is in default of delivery when one of these events occurs.
2.3. In the event of a hindrance to performance within the meaning of Section 1 for more than one month, big market and the customer are entitled to withdraw from the contract with regard to the delayed delivery. If the delivery date is not met for reasons other than those stated in Section 1, the right of withdrawal exists only for the customer. For the customer to withdraw from the contract, they must have given big market a reasonable grace period of at least two weeks in writing, with a warning of rejection.
2.4. In commercial transactions, big market is entitled to make partial deliveries.
- Delivery, Transport, Assumption of Risk
3.1. The risk is transferred to the customer upon handover to the transport company. This also applies if partial deliveries are made or if big market has assumed additional services, e.g., transport costs or delivery.
3.2. Transport is carried out by DHL or DPD. Upon handover to the transport company, big market is released from its obligation to perform. The goods are transported at the customer's risk and expense.
3.3. If the customer defaults on acceptance, big market is entitled to claim compensation for the resulting damages, whereby the customer reserves the right to prove that the damages were less.
3.4. Parcels are insured by DHL up to a value of €500. Parcels to delivery addresses outside Germany can only be insured if the customer bears the corresponding additional costs.
- Conclusion of Contract
4.1. All offers from big market are subject to change. A contract is only concluded upon order confirmation or delivery by big market. Unless otherwise agreed, the customer is bound to the order for 14 days.
4.2. All prices include all German taxes and other price components. Delivery and shipping costs also apply and are stated separately in the specific offer. Foreign import duties are not included in our prices; these are always to be paid by the recipient of the goods in the respective country.
- Warranty, Inspection Obligations
5.1. big-market guarantees, within the scope of the following provisions, that deliveries and services are free from defects within the meaning of the warranty law for the duration of the statutory warranty period.
5.2. Obvious defects must be reported in writing no later than 14 days after receipt of the delivery. In commercial transactions, it is necessary that the commercial customer has properly fulfilled their inspection and complaint obligations pursuant to Sections 377 and 378 of the German Commercial Code (HGB).
- Retention of Title
6.1. big-market retains title to delivered goods until full payment has been made.
- Payment
7.1. Payment is only possible in cash, in advance, or cash on delivery.
7.2. big-market is also entitled to charge default interest at a rate of 3% above the current discount rate of the Deutsche Bundesbank, but at least 10% per annum, as damages for late payment.
- Liability
8.1. In the event of a breach of essential contractual obligations, big-market is liable for damages caused by the breach. Otherwise, liability only applies in cases of intent or gross negligence.

In accordance with EU Regulation No. 524/2013 (Online Dispute Resolution in Consumer Matters), the European Commission provides a platform where you, as a consumer, can request out-of-court dispute resolution for disputes with us as an online retailer regarding your online purchase contracts.

- Place of Performance, Jurisdiction
10.1. The place of performance for all claims arising from the contractual relationship between the customer and big market is Berlin.
10.2. If the customer is a merchant within the meaning of the German Commercial Code (HGB), a legal entity under public law, or a special fund under public law, Berlin shall be the exclusive place of jurisdiction for all disputes arising directly or indirectly from the contractual relationship.
